This privacy policy (“Privacy Policy”) applies to any website, application, feature, widget or other online service that is owned or controlled by Premium Brand Services LLC, or any of its affiliates or subsidiaries (“Ascena”, “we”, or “us”) and that posts a link to this Privacy Policy (the “Site”). This Privacy Policy also does not apply to any other website, application, or other online service that is owned or controlled by Ascena but does not post a link to this Privacy Policy, nor does it apply to information collected offline by Ascena, unless otherwise expressly stated at the time of collection. This Privacy Policy describes the collection, use, and sharing of your personal information.

By accessing, using, or otherwise interacting with any part of our Site, you consent to this Privacy Policy and any additional applicable policies and terms you may agree to which govern your use of this Site. 

INFORMATION WE COLLECT

We may collect information from you directly, automatically when you visit our Site, and sometimes from third parties. Some of this information may be considered “personal information” or “personal data” under various applicable laws. We consider information that identifies you as a specific identified individual (such as your name, phone number, and email address) to be personal information. We also treat additional information, including IP addresses and cookie identifiers, as personal information where required by applicable law. Note that we may de-identify personal information so that it is non-personal, such as aggregating or converting it to a code, sometimes using a function commonly known as “hash”. We will treat de-identified information as non-personal to the fullest extent allowed by applicable law. If we combine non-personal information with personal information, then we will treat the combined information as personal information under this Privacy Policy.

Information You Provide Directly.  We may ask you to provide certain information to us (including your personal information) when you use the Site or offline. For example, you may give us your information when utilizing a “Contact Us” feature, subscribing to our mailing list, or interacting with other interactive features. 

Information We Receive From Third Parties.

We may receive information, including personal information and demographic information, about you from third parties, for example, third parties who forward your job application in connection with a job offering or from sources of publicly available information. We may also combine information about you that we have with information we obtain from business partners or other companies. In those cases, we will apply this Privacy Policy to the combined information. The information collected and stored by a third party is subject solely to the third party’s privacy practices. 

Information We Collect Automatically.

Ascena and our third-party service providers, including analytics providers and third-party content providers, may automatically or passively receive and record certain information about your use of the Site whenever you visit or interact with the Site, such as: your IP address, mobile device identifier, or similar device identifier; browser type; type of device you use to access the Site; the domain name from which you arrived at the Site; the time of day you visit our Site; and specific pages or areas of the Site through which you navigate and how you interact with those pages or areas (“Usage Information“). This information helps us create a better experience for our users.

The methods used to collect Usage Information may include:

Cookies and Local Storage. We use cookies and similar tracking technologies to support our Site and to track and improve activity on our Site. Cookies are small text files stored locally on your device when the device is used to visit a Site and allow a certain Internet site to recognize the device whenever the device is used to visit the site. These technologies may be used for many purposes by us and our third-party service providers, such as automatically collecting Usage Information, enabling features, and remembering your preferences. Web Beacons. Small graphic images or other web programming code called web beacons (also known as “pixel tags,” “1×1 GIFs,” or “clear GIFs”) may be included in our web pages and email messages. Web beacons may be invisible to you, but any electronic image or other web programming code inserted into a web page or email can act as a web beacon. Web beacons or similar technologies may be used for a number of purposes, including, without limitation, to count visitors to the Site, to monitor how users navigate the Site, to count how many emails that were sent were actually opened or to count how many particular links were actually viewed.

Embedded Scripts. An embedded script is programming code that is designed to collect information about your interactions with the Site, such as the links you click on. The code is temporarily downloaded onto your device from our server or a third-party service provider, is active only while you are connected to the Site, and is deactivated or deleted thereafter.

In addition, we may use a variety of other technologies that collect similar information for security and fraud detection purposes.

HOW WE USE YOUR INFORMATION

We may use non-personal information for any purpose allowable by law, including for advertising, research, and marketing purposes. We may use information collected from or about you, including your personal information and Usage Information, as disclosed in this Privacy Policy, including to:

  • allow you participate in the Site or features or activities we offer;
  • communicate with you, including through email newsletters, in response to users who have contacted us, with administrative communications, and, in our discretion, regarding changes to our Privacy Policy, Terms of Use, or any of our other terms or policies;
  • process your employment application;
  • protect each party from errors, misuse of the Site, fraud, or any criminal activity;
  • improve the Site or our products and services and for legal, regulatory and internal business purposes;detect and troubleshoot problems, resolve disputes, and enforce applicable agreements and policies for the Site; and
  • fulfill any other purpose consistent with this Privacy Policy or for purposes disclosed to you at the time of collection or with your consent.

 

HOW WE SHARE YOUR INFORMATION  

We may share non-personal information, such as Usage Information, hashed or otherwise de-identified data, and aggregated user statistics, with third parties in our discretion. We may share the information we have collected about you (including personal information) in the circumstances described below or elsewhere in this Privacy Policy, as disclosed at the time you provide information or otherwise with your consent. We do not share personal information with third parties for those third parties’ own marketing purposes unless you have consented to such sharing.

Affiliates & Subsidiaries

Ascena may share your information, including personal information, with our affiliates and subsidiaries for business, analytical, and operational purposes.

Service Providers We may use third-party service providers to perform certain services on our behalf, such as hosting the Site features, providing customer service, providing website usage analytics, sending email, direct mail or other communications, providing marketing assistance and data analysis or enhancement, or performing other administrative services. We may give these service providers access to your information (including personal information) so that they can carry out the services they are performing for you or for Ascena.

When You Agree to Receive Information from Third Parties or Request That We Share Your Information.

We may share information when you direct us to do so. Please note that we are not responsible for the privacy practices of third parties. I If you later decide that you no longer want to receive communications from a third party, you will need to contact that third party directly.

Business Transfers and Transitions

In the event Ascena goes through a transition (such as a merger, acquisition, bankruptcy or sale of all or a portion of its assets, including, without limitation, during the course of any due diligence process), your information (including your personal information) will likely be among the assets transferred. By providing your personal information, you agree that we may transfer such information to the acquiring entity without your further consent.

Administrative and Legal Reasons

Ascena reserves the right to use or disclose any information (including personal information) as needed to satisfy any law, regulation or legal request; to protect the integrity of the Site; to fulfill your requests; to cooperate in any law enforcement investigation, an investigation on a public safety matter, or an investigation into claims of intellectual-property infringement; to protect and defend the legal rights or property of Ascena, our affiliates, subsidiaries, and shareholders,  the Site or its users, or any other party; or, in an emergency, to protect the health and safety of our users or the general public.

THIRD-PARTY LINKS & CONTENT

The Site may link to or incorporate websites or content hosted and served by third parties over which we have no control and which are governed by the privacy policies and business practices of those third parties. If you click a third party link, you will be directed to that third party’s site. We strongly advise you to review the privacy policies of every site you visit. Ascena is not responsible for the privacy practices or business practices of any third party.

THIRD-PARTY ADVERTISING AND ANALYTICS PROVIDERS

We may work with analytics service providers to provide us with information regarding use of and traffic on the Site (including without limitation the pages viewed and the actions users take when visiting the Site). These service providers may set and access their own tracking technologies on your device (including without limitation cookies and web beacons) and may otherwise collect or have access to information about you (such as Usage Information and device identifier). Some of these parties may collect personal information over time when you visit the Site or other online websites and services. We may share certain information such as device identifiers, Usage Information, and de-identified information with these analytics providers.

One analytics provider with whom we may work is Google Analytics. Google Analytics uses cookies and similar technologies to collect and analyze information about use of the Site and report on activities and trends. This service may also collect information regarding the use of other websites, apps, and online resources. HOW WE RESPOND TO “DO NOT TRACK” SIGNALS

Some Internet browsers may be configured to send “Do Not Track” signals to the online services that you visit. There is no consensus among industry participants as to what “Do Not Track” means in this context. Like many websites and online services, our Site do not alter their practices when they receive a “Do Not Track” signal from a visitor’s browser. GENERAL AUDIENCE PLATFORM

Our Site is intended for a general audience and are not intended for use by or targeted to children younger than the age of 18. We do not knowingly collect personal information from children younger than the age of 18. If we learn that we have inadvertently collected personal information from a user who is younger than age 18, we will delete that information from our active databases. If you are the parent or legal guardian of a child younger than 13 and believe that we have inadvertently collected personal information from your child, please contact us using the information in the “Contact Us” section below.

SECURITY OF YOUR INFORMATION

We employ commercially reasonable security methods and technologies to help secure your personal information, including physical, technological, and organizational protections. However, no system can be guaranteed 100% secure. We therefore cannot ensure or warrant the security of any information that you transmit to us, or that we transmit to you, or guarantee that it will be free from unauthorized access by third parties. You use the Site and provide us with information at your own initiative and risk.

CONSENT TO TRANSFER

Ascena is a United States company.  Please be aware that information we collect will be transferred to and processed in the United States and other countries. By using the Site, or providing us with any information, you fully understand and unambiguously consent to this transfer, processing, usage, sharing, and storage of your information in the United States and other jurisdictions, for which the privacy laws may not be as comprehensive as those in the country where you reside and/or are a citizen. As a result, this information may be subject to access requests from governments, courts, or law enforcement in the United States and other countries according to laws in those jurisdictions. Your information will also be disclosed to third parties as described in the “How We Share Your Information” section above. 

ACCESSING AND UPDATING YOUR PERSONAL INFORMATION. 

If you have an online account through the Careers portal you are responsible for maintaining and updating, as applicable, your account registration data with current, accurate, and complete information. You may have the ability to view, update, and/or edit the registration data you have provided to us by logging in to your account and following the appropriate instructions. If we offer and you utilize such a feature, we will make requested changes in our active databases as soon as reasonably practicable. Note, however, that we may retain information that you have updated or changed for internal or administrative purposes.

CHANGES TO THIS PRIVACY POLICY

To the extent permitted by applicable law, we reserve the right to change or modify this Privacy Policy in our discretion at any time and without prior notice. If we make material changes to this Privacy Policy, we will update the effective date at the top of this policy. We may also provide notice to you in other ways in our discretion, such as through contact information you have provided, and provide you with the ability to opt-in or opt-out of the changes if required by law. Any changes will be effective immediately upon the posting of the revised Privacy Policy unless otherwise specified, and your continued use of the Site after the effective date of the revised Privacy Policy (or such other act as specified in the revised Privacy Policy) will constitute your consent to those changes.
